1. Introduction

By securing a charter or using our Service, you consent to these Terms. If you do not agree with any part of the terms, then you must not use the Service.

2. Service Overview

PebbleTimberPath offers luxury yacht charter services, which include:

• Yacht rentals for a day
• Evening boat trips
• Company outings
• Exclusive gatherings
• Long-term yacht hires

All offerings are dependent on availability and weather situations. We may adjust or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To reserve a yacht, you are required to:

• Be of 18 years or older
• Submit true and complete details
• Make the necessary prepayment as noted in your booking agreement
• Agree to these Terms & Conditions

3.2 Confirmation

A booking is only confirmed upon the completion of the payment and our provided confirmation in writing. We reserve the discretion to decline services to any individual.

3.3 Availability

All yacht hires are subject to the availability of the vessel and favorable weather conditions. We will endeavor to meet your preferred times and dates.

4. Payment Terms

4.1 Pricing

All quotations are in $ and include relevant taxes unless stated otherwise. Pricing is subject to amendment without prior notification.

4.2 Payment Schedule

• Initial Payment: 50% of the total cost for the trip is due when booking
• Final Payment: Payable 48 hours prior to the departure of the yacht
• Additional costs (if they apply): Payable upon the journey's end

4.3 Payment Methods

We accept key credit cards, electronic bank payments, and authenticated cheques. Our payment processing occurs over secure, encrypted systems.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• If canceled more than 72 hours before departure: Full reimbursement less transaction fees
• Between 24 to 72 hours prior to departure: A refund of 50% provided
• Within 24 hours of departure: No reimbursement provided

5.2 Weather Cancellations

In the case that our captain regards weather conditions as unsafe, we will offer to:

• Reschedule your booking to another available date with no added costs
• Issue a complete refund if rearrangement is not feasible

5.3 Mechanical Issues

Should there be mechanical issues with the vessel scheduled for your trip, we will attempt to provide a fitting alternative. If no substitution is accessible, a full refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All passengers must:

• Adhere to directions given by the crew
• Utilize assigned safety equipment as necessary
• Inform of any health conditions that could influence their security
• Stay within the areas approved for passengers on the vessel

6.2 Prohibited Items

The following items are not permissible onboard:

• Containers made of glass
• Illegal substances
• Guns or other weapons
• Pets (except for pre-authorized situations)

6.3 Conduct

Passengers are expected to behave in a polite and respectful manner. We maintain the right to end a booking early with no reimbursement if passenger behavior endangers safety or disrupts others' experiences.

7. Liability and Insurance

7.1 Our Liability

We are accountable solely up to the cost incurred for your yacht hire. We are not liable for:

• Personal injuries due to passenger negligence
• The loss of or harm to personal effects
• Indirect, consequential, or penal damages
• Delays from weather or situations beyond our influence

7.2 Insurance Coverage

We hold comprehensive marine insurance for our fleet and operations. It is recommended that passengers have their travel and personal insurance.

7.3 Assumption of Risk

By engaging in our yacht hiring services, you accept that marine activities come with intrinsic risks, and you take charge of your own security and wellness.

8. Modifications and Itinerary Changes

We retain the right to vary itineraries, paths, or timetables as affected by weather circumstances, safety priorities, or operational demands. Every attempt will be made to provide satisfactory alternative experiences.

9. Force Majeure

We are not accountable for any postponement, cancellation, or amendment caused by conditions outside of our control, such as:

• Harsh weather circumstances
• Natural calamities
• Government edicts
• Closure of ports
• Breakdowns mechanically

10. Privacy and Data Protection

Your individual information is processed in line with our Privacy Policy. By utilizing our services, you consent to the gathering and usage of your data as outlined in our Privacy Policy.

11. Intellectual Property

These Terms are subject to the laws present within U.S. Virgin Islands. Any disputes are to be settled in the courts of St. Thomas, U.S. Virgin Islands.
